Trench Safety: OSHA Excavation Requirements 2026 (The 5-Foot Rule, Soil Types, Slope-Shore-Shield)

A single cubic yard of soil weighs around 3,000 pounds — a small pickup truck. When a trench wall lets go, the worker inside takes several of those in under two seconds, and the crew on top usually can't do a thing except call it in. Trench collapses kill dozens of workers every year in the U.S., and OSHA treats excavation violations (29 CFR 1926 Subpart P) as some of the most serious citations it writes — willful trench cases are where six- and seven-figure penalties happen.

The 5-Foot Rule
Any trench 5 feet deep or more requires a protective system — sloping, benching, shoring, or a trench shield. No exceptions for "we'll only be in there a minute" (that's the sentence that precedes most fatalities).
- Under 5 feet: a competent person may waive protection only if their examination shows no indication of a potential cave-in
- 20 feet or deeper: the protective system must be designed by a registered professional engineer
Access: The 25-Foot Ladder Rule
Trenches 4 feet or deeper need a ladder, stairway, or ramp within 25 feet of lateral travel for every worker in the trench — so nobody is ever more than 25 feet from a way out. The ladder follows the same rules as everywhere else, including extending 3 feet above the top (ladder requirements here).
The Competent Person and the Daily Inspection
A competent person must inspect the excavation, adjacent areas, and protective systems:
- Daily, before work starts
- After every rainstorm
- After any event that could increase hazards — vibration from nearby equipment, a freeze-thaw cycle, new surcharge loads
They're checking for tension cracks along the top, water seepage, bulging walls, spalling faces, and any change in soil condition. Their call is final: if they say get out, the trench is closed until it's fixed. This is exactly the kind of documented daily check a job hazard analysis should feed.
Know Your Soil — It Sets Your Slope
The protective system depends on soil classification, which the competent person determines with at least one visual and one manual test:
- Type A (clay, hardpan): slope 3/4:1 — 53 degrees
- Type B (angular gravel, silt, previously disturbed soil): slope 1:1 — 45 degrees
- Type C (sand, gravel, submerged or seeping soil): slope 1 1/2:1 — 34 degrees
Two things crews get wrong: previously disturbed soil can never be Type A (and almost every utility trench is previously disturbed), and any soil with water seepage is Type C. When in doubt, treat it as Type C — the flat slope.
Slope It, Shore It, or Shield It
- Slope/bench — cut the walls back to the angle for your soil type. Cheap, needs room.
- Shore — hydraulic or timber supports that hold the walls up. For tight urban cuts.
- Shield (trench box) — doesn't stop the collapse, protects the workers inside it. Workers stay inside the box, never in the trench outside it, and the box gets moved with nobody in it.
The Rest of the Fatal List
- Spoil pile 2 feet back from the edge — spoil and equipment at the lip both surcharge the wall and rain rocks on heads
- Call 811 before you dig — utility strikes turn a trench job into an electrocution or gas event
- Water accumulation — no work in a trench with standing/accumulating water without special precautions (pumps, and Type C treatment)
- Atmosphere testing in trenches deeper than 4 feet where oxygen deficiency or gases are possible (near landfills, gas lines, sewers)
- Keep workers out from under loads and away from the digging bucket
- Barricade the excavation for vehicles and pedestrians; walkways with guardrails over crossings
The Pre-Entry Checklist
- Protective system in place for anything 5 feet+ (engineer-designed at 20 feet+)
- Competent person inspected today, after any rain
- Soil classified — Type C assumed if wet or previously disturbed
- Ladder within 25 feet, sticking 3 feet above the top
- Spoil and equipment 2+ feet back from the edge
- 811 locates marked and current
