At the initial heat trigger — heat index of 80°F:
- Drinking water: cool, accessible, at least 1 quart per worker per hour
- Break areas: shade outdoors (or A/C indoors) close to the work
- Acclimatization for new and returning workers (more on this below — it's where people die)
- A written Heat Injury and Illness Prevention Plan with a designated coordinator
- Training for workers and supervisors on heat illness signs and response
At the high heat trigger — heat index of 90°F:
- Paid rest breaks (the proposal: 15 minutes every 2 hours)
- A buddy system or supervisor observation so no one works alone and unwatched
- Hazard alerts reminding crews about water, breaks, and emergency procedures
Check the heat index — temperature plus humidity — not just the thermometer. 88°F at 70% humidity is a heat index over 100°F.
Acclimatization: The Rule That Saves the Most Lives
Roughly 3 out of 4 heat fatalities happen in a worker's first week on the job. Bodies need time to adapt to working in heat, and new hires, workers back from a week off, and the first heat wave of the season are the danger zones.
The standard approach (NIOSH-based, and what the proposed rule codifies):
- New workers: start at 20% of a normal shift's heat exposure on day one, adding no more than 20% each day
- Returning workers (away 1–2 weeks): start at 50%, ramp back over 4–5 days
- Everyone: treat the first heat wave of the year like week one — dial intensity down and watch each other

Recognize It Fast: Heat Exhaustion vs. Heat Stroke
Every worker and every foreman should know this split:
Heat exhaustion — heavy sweating, weakness, dizziness, headache, nausea, clammy skin. Response: move to shade, loosen clothing, sip water, cool with wet cloths. Don't leave them alone.
Heat stroke — a 911 emergency — confusion, slurred speech, aggression, hot dry skin or profuse sweating, collapse, seizure. Response: call 911 immediately, then cool aggressively — ice, cold water, wet towels, fan. Every minute of delay causes damage. Never "let them sleep it off" in a truck.
The buddy system exists because heat stroke destroys the victim's own judgment — confused workers don't self-report. Someone has to be watching.
Your Jobsite Heat Safety Checklist
Run this daily once forecasts hit 80°F heat index:
- ☐ Checked today's heat index (not just temperature) before the shift
- ☐ Water: 1 quart per worker per hour, cool, within easy reach of the work
- ☐ Shaded break area set up close enough that crews actually use it
- ☐ Rest breaks scheduled — every 2 hours when the index tops 90°F
- ☐ New/returning workers on a reduced acclimatization schedule
- ☐ Buddy system assigned; supervisor knows who's new
- ☐ Heaviest work scheduled for morning where possible
- ☐ Crew reminded of heat illness signs at the morning huddle
- ☐ Emergency plan posted: who calls 911, site address visible, ice/cooling supplies on hand
- ☐ Anyone on high-risk meds or returning from illness flagged for extra observation

State Rules May Be Stricter
If you work in a state-plan state, the state rule wins where it's tougher:
- California: shade required at 80°F, high-heat procedures at 95°F, plus an indoor heat rule
- Oregon & Washington: rules trigger at 80°F with mandated cool-down periods
- Colorado, Maryland, Nevada, Minnesota: state heat protections in force or phasing in
Multi-state contractors should build one program to the strictest standard they touch — it's simpler than running different rules per state, and it's where the federal rule is headed anyway.

Until the federal rule is final, inspectors use the General Duty Clause (Section 5(a)(1)) plus the heat NEP.
